Building Permits & Inspections

Ensuring the longevity and safety of our City

The Building Permits and Inspections Department handles the issuance of all building permits and occupancy permits for residential and commercial properties, as well as signage permits. The Department handles all required inspections for property maintenance, building, electrical, plumbing, and occupancy permits.

Building permits shall be obtained prior to making improvements or alterations to a property.

Building Permit Requirements

Commercial Building Requirements

Application filled out with general description of the proposed work.

Application to be accompanied by no less than 3 sets of construction documents. When scope of work is of a minor nature, this requirement may be waived by the Building Official. One of the 3 sets of documents issued will be returned to the applicant or person(s) securing the permit. The stamped, approved and endorsed plans shall be kept at the building site, open to inspection by the Building Official or authorized representative.

Construction documents to be prepared by a registered design professional registered with the State of Illinois, including name and address of said design professional and shall be signed, sealed, and dated, according to laws of Illinois.

Construction documents to include site plan, showing to scale the size and location of all new construction and existing structures on the site, distances from lot lines, established street grades and proposed finished grades. Site plan shall indicate the location of all private sewage disposal systems where a public sewer is not available.

In case of demolition, site plan shall show all construction to be demolished and location and size of all existing structures and construction that is to remain on site of plot.

Construction documents to include engineering details of structural, mechanical, plumbing and electrical work, including computations, stress diagrams and other essential technical data. All engineering plans and computations shall bear the signature and seal of the engineer or architect responsible for the design.

Construction documents to include Stormwater Management Plan, per Ordinance No. 840-95: 10-3-95. Plan shall identify means of controlling the stormwater runoff. All computations, plans and specifications must be prepared by a registered professional engineer of the State of Illinois and must be reviewed by the City Engineer.

Yard Sale Permits
  1. 8-6-1 DEFINITIONS
    Included within the terms of this Article, and heretofore referred to as “yard sales”, is any display of merchandise for the purpose of exchanging it for legal tender or barter at a location not otherwise regularly used or specifically designated for the sale or exchange of merchandise. Events commonly known as “garage sales”, “tailgate sales”, “flea markets”, “house sales”, “moving sales”, etc., shall be defined as yard sales under the provisions of this Article.
  2. 8-6-2 PERMIT; EXCEPTION
    No person or persons shall offer for sale any merchandise, or permit the use of his or her property, in conjunction with a yard sale without first obtaining a permit therefor at least one (1) day in advance of the first day of the yard sale. The provisions of this Section shall not apply to bankruptcy, estate or other sales under judicial process, licensed and authorized auctions and sales conducted at or by organizations affiliated with churches, schools, federal, state, city, county and township government units provided that those organizations are non-profit, religious, civic and/or charitable in nature.
  3. 8-6-3 ISSUANCE OF PERMIT
    The Administrative Official is authorized to issue a “Yard Sale Permit” as required by this Article to any resident person upon request provided the permit be completed to include the name and address of the applicant, and the duration and the location of the yard sale. Permit shall be posted at site of sale.
  4. 8-6-4 SIGNS
    One sign may be posted away from the location of the sale no sooner than 5:00 P.M. on the day prior to the sale. Sign may be up to four (4) square feet in area containing name, address and signature of permit holder. Such signs shall not be located on private property without consent of the property owner. Signs may not be attached to utility poles, traffic signals, street signs or other safety control objects. All signs shall be removed within twenty-four (24) hours of the conclusion of the sale by the applicant.
  5. 8-6-5 LOCATION
    (A) Yard sales shall be restricted to residential and non-commercial districts under Chapter 14, Article II of the Revised Code, unless otherwise approved by City staff. (B) Yard sales conducted by and for the benefit of non-profit organizations may be held in zoning districts other than residential and non-commercial.
  6. 8-6-6 DURATION
    (A) No yard sale shall be conducted for a period greater than three (3) successive calendar days. (B) Yard sales shall be conducted with the period between sunrise and sunset.
  7. 8-6-7 FREQUENCY
    (A) Yard sales shall be held no more than three (3) times within the same calendar year at the same location. (B) Yard sales shall be held no sooner than thirty (30) days subsequent to the close of a yard sale at the same location.
  8. 8-6-8 PROHIBITED MERCHANDISE
    Prohibited from such merchandise to be sold at yard sales shall be alcoholic beverages, firearms, firearm ammunition, materials determined by the City Code as obscene, animals, or any other merchandise of which sale without proper licensing or authorization from state or local authorities is unlawful.
  9. 8-6-9 ON-SITE ADVERTISING
    Prohibited at the location of any yard sale are loud speakers, amplifiers, and signs defined as “prohibited” under Section 14-7-7 of this Code
  10. 8-6-10 PENALTY
    Any person who violates any provision on this Article, shall, upon conviction, be fined One Hundred Dollars ($100).(Ord. No. 1011-00; 08-01-00) [Supplement No. 52; 02-01-01]
Occupancy Permits

All rental and owner-occupied property within the Corporate limits of the City of Fairview Heights is required to have an updated Occupancy Permit on file with the Land Use and Development Department. Any changes in tenancy requires the Occupancy Permit to be updated by the tenants and/or owner of record.

How to Obtain an Occupancy Permit
The property must have passed a Property Maintenance Inspection within the last 12 months, the requirements of which are outlined in the Property Maintenance Inspection Guide (PDF). You may schedule and verify inspections with the Land Use and Development Department at 618-489-2060. This inspection must be scheduled by the property owner or manager.

Once the property has passed inspection, complete the Application for Occupancy Permit. Submit this application and permit fee to City Halll, and the Occupancy Permit will be issued once the application and fee are secured.

Please Note
Updates to existing Occupancy Permits for rental property may require the owner and/or landlord’s approval prior to any change becoming finalized.

Sign Permit Requirements

No sign shall be erected, altered, or relocated without a permit issued by the Administrative Official, except as otherwise provided herein. Where electrical permits are required, they shall be obtained at the same time as the sign permit.

Construction documents to be prepared by a registered design professional registered with the State of Illinois, including name and address of said design professional and shall be signed, sealed, and dated, according to laws of Illinois.

About the Sign Permit Application

The permit application shall contain the location of the sign structure, the name and address of the sign owner and of the sign erector, drawings showing the design and location of the sign and such other pertinent information as the Administrative Official may require to insure compliance with the Codes and Ordinances of the Municipality.

Temporary Signage

Temporary Signage can be applied for once per quarter (4 times per year). Duration of the Temporary Sign Permit is 10 calendar days and must be approved in advance by Land Use & Development.

Nulification

A sign permit shall become null and void if the work for which the permit was issued has not been completed within a period of six (6) months after the date of the permit. Permit fee shall not be refunded.

Permit Exemptions

The following operations shall not be considered as creating a sign and therefore, shall not require a sign permit:

Maintenance
Miscellaneous Signs

Replacing Copy

The changing of the advertising copy or message on an approved painted or printed sign or marquee and similarly approved signs which are specifically designed for the use of replaceable copy.

Maintenance

Painting, repainting, cleaning and other normal maintenance and repair of a sign or a sign structure unless a structural change is made.

Miscellaneous Signs

As per Section 14-7-6 of this Code, miscellaneous signs are also exempt from permit requirements.
